Class of 1881. George Sutherland was born in England on March 15, 1862. His parents, Alexander George Sutherland and Frances Slater Sutherland, joined the Church of Jesus Christ of Latter-day Saints and moved to Utah when Sutherland was a child. His name was the same as his father's, but on coming of age he dropped "Alexander". The Sutherland family became disaffected from the Mormon Church. After attending Brigham Young High School and Academy, Sutherland attended the University of Michigan Law School, where he was taught by the 19th century constitutional law scholar Thomas M. Cooley. George married Rosamond Lee. Sutherland returned to Utah in 1883, and practiced law first with his father in Provo, and then with others in Salt Lake City. Sutherland was a member of the Utah Territorial Legislature, and a State Senator from 1896-1900. He then was elected to the House of Representatives. In 1905, Sutherland was appointed by the Utah Legislature to the Senate, where he served two terms. In 1922, President Warren G. Harding nominated Sutherland to the Supreme Court. Sutherland strongly believed individuals possessed natural rights with which the state was forbidden to interfere, but his opinions suggest an inconsistent position on these matters. For example, Sutherland dissented without opinion in Meyer v. Nebraska, which held that the state was not permitted to bar the teaching of German in private schools. The Court relied on the right of parents to raise their children largely as they chose, a classic effort at using natural rights views to declare unconstitutional state regulation. Because he did not write an opinion, we do not know why Sutherland dissented in Meyer. The only other dissenter was Oliver Wendell Holmes, who regularly sustained such state legislation. That same year, Sutherland wrote the opinion of the Court in Adkins v. Childrens Hospital, which held unconstitutional a law establishing a minimum wage for women in the District of Columbia (a law which had been upheld in Muller v. Oregon). The opinion in Adkins relies on a notion of natural rights regarding "liberty of contract." While a legislator in Utah, Sutherland supported a maximum hour regulation for miners, which the Court upheld in Holden v. Hardy (1898). For Sutherland, there existed a distinction between minimum wages and maximum hours, a distinction rejected by most. In 1925, Sutherland joined the unanimous opinion of the Court in Pierce v. Society of Sisters, which was based on the principles stated in Meyer. He did not write an opinion explaining whether he was merely acquiescing to the precedent created by his brethren in Meyer, or for some other reason. Sutherland also wrote the Court's opinion permitted zoning regulations in Euclid v. Ambler Realty against a property right challenge in 1926. He dissented in Home Building & Loan Ass'n v. Blaisdell (1934), which permitted Minnesota to adopt a mortgage redemption moratorium period during the Great Depression, on property rights grounds. During the Great Depression, Sutherland was considered the leader of the Four Horsemen (Pierce Butler, James McReynolds and Willis Van Devanter were the others) preventing implementation of the New Deal during the mid-1930s. The demonizing of these members of the Court (the legendary Four Horsemen of the Apocalypse were Death, Famine, Pestilence and War) was part of the Progressive effort to reverse the decisions of this "anti-New Deal" Court. Even though FDR's court-packing plan (see bio for Charles Evans Hughes) failed to pass, the Court did change its mind, and the members of the Court opposed to the New Deal began to leave the Court after the constitutional crisis of 1937. Sutherland was a bright, hard-working judge whose fate was to be linked to other Justices whose reactionary politics or racist beliefs are anathema. Sutherland retired from the Court on January 17, 1938. He died on July 18, 1942. ~ ~ ~ ~ Born in England, Sutherland lost his first election for public office when he failed in his bid for mayor of Provo in 1892. Thereafter, however, he notched several political victories: Utah State Senate (1896), U.S. House of Representatives (1900), and finally to the U.S. Senate (1904). Sutherland, who helped found the Utah State Bar, sat on the U.S. Supreme Court from 1922-38.

Class of 1914 ~ Honorary. Laura Swallow Beckstrand, age 103, died January 19, 2000 in Orem, Utah. She was born December 15, 1896, in Fillmore, Utah, to Charles and Isabel Swallow. Laura married Joseph Clifton Beckstrand October 3, 1917, in the Salt Lake Temple. Laura and Clifton lived in Meadow, Utah, where they farmed and raised their family. Laura finished the eighth grade in Meadow, then attended Brigham Young Academy in Provo, where she played the French horn in the school band. She remained a loyal BYU sports fan throughout her life. After her marriage she became a homemaker, skilled at gardening, quilting, handwork, and cooking. Laura was hard worker, mannerly and kind-hearted, who devoted her life and resources to the service of family and friends. She was active in the LDS Church, serving as ward and stake Relief Society president and in many other positions of service. She loved temple work, serving with Clifton as an ordinance worker in the Manti Temple for seven years. She faithfully attended the temple throughout her long life. She is survived by her children, Nelda (Alex) Wadley, Pleasant Grove; Thressa Knoell, Orem; Therald (Verla) Beckstrand, Orem; 14 grandchildren, 29 great-grand-children, 11 great great-grandchildren; two sisters, Elva Lindberg and Noreen Labrum; and a brother, Theron Swallow. She was preceded in death by her husband Clifton; daughters, Lavon and Rhea; eight brothers and sisters; and a grandson, James Clifton Beckstrand. Funeral services were held Monday, January 24, 2000 in Pleasant Grove. A graveside service was held in Meadow, Utah prior to burial in the Meadow Cemetery. He played on the basketball team during his school years. ~ ~ ~ ~ OBITUARY: Albert Donald Swensen, age 86, passed away at his home in Provo on Saturday, Oct. 6, 2001 from causes incident to age. He was born May 28, 1915 in Provo, Utah to John C. and Margaret Davis Swensen. He first married Jennie Romney on June 15, 1937. Together they are the parents of six children: Marilyn (Ted) Hess, missionaries in Samoa; A. John Swensen of Sandy; Donald G. (Louise) Swensen of Sandy; Philip R. (Dana) Swensen of Hyde Park; Margaret Swensen (Dennis) Lifferth of Centerville; and Kathryn Swensen (Paul) Graf of Santa Clara. Jennie preceded him in death in 1980. He second married Marjorie Hanseen on July 1, 1983. She brought to the family her four children: Craig Seegmiller (deceased) and his wife Judy, Salt Lake City; Cary Seegmiller, Provo; Mary Haymond, Orem; and Patricia (George) Burton, Orem. Ab Swensen was a professor of Chemistry at Brigham Young University from 1947 until he retired in 1980. He was a gifted teacher and received numerous awards and recognition including the Karl G. Maeser Award for Teaching Excellence during his tenure at B.Y.U. He was an active member of the LDS Church and served in various positions including two tenures as bishop. He and his wife, Marjorie, served in the Vienna Austria Mission from 1984-86. They also gave devoted service in the Provo Temple. However, Ab's greatest service given throughout his life was evident in his sense of humor and his ability to love, accept, and encourage all who knew him. He is survived by his wife, Marjorie, nine children, 41 grandchildren, and 40 great- grandchildren. He is also survived by two brothers, Richard D. (Arleen) Swensen of Orem and Joseph C. Swensen of Booth Bay Harbor, Maine. Funeral services were held Thursday, Oct. 11, 2001 in Provo. Interment, Provo City Cemetery. Following his mission, he earned a B.S. in Bacteriology (Microbiology) with a minor in Chemistry from BYU, where his father and grandfather both taught. His career as a medical technologist took him to Los Angeles and then back to Utah where he worked for Holy Cross Hospital, Primary Children's Medical Center, Utah Valley Medical Center, and Alta View Hospital. He had many close friends among his colleagues. He was sealed to his beloved wife Louise Esplin in the Salt Lake Temple on March 1, 1982. He was an affectionate husband who adored being a father to Jennie and Scott. He devoted all his spare time to nurturing and supporting them unconditionally, settling his last 20 years in Sandy. Don retired six years ago and took the opportunity to pursue some of his other passions. He loved to paint, play handyman around the house, care for his yard, and travel the world from Jerusalem to Europe. At church he particularly enjoyed serving in the Primary. Don is survived by his wife, Louise; daughter, Jennie; son, Scott Donald; sister, Marilyn Hess (Ted); twin brother John; brother, Philip (Dana); and sister Margaret Lifferth (Dennis). He was preceded in death by his parents and his sister Kathryn Graf (Paul). A viewing will be held on Monday, August 23rd from 6 to 8 p.m. at Larkin Sunset Gardens, 1950 E. 10600 So. He married Verna Harding. Joseph C. Swensen died on May 9, 2005. ~ ~ ~ ~ His parents were John C. Swensen (Swenson), born February 4, 1869 [BYA High School 1888, BYA Collegiate 1900], married Margaret Davies (Davis) Swensen. John originally used the -SON spelling, but later in life he decided it would be better to use the -SEN spelling. Joe's parents, John and Margaret Swenson/Swensen, had ten children; five of the children continued with the -SON spelling, but the other five changed and used the -SEN spelling. She was born April 11, 1951 to Albert Donald Swensen and Jennie Romney Swensen. She married Paul Fenwick Graf in the Salt Lake City Utah Temple on August 13, 1976. Kathy was born and raised in Provo, Utah. She attended Wasatch Elementary, BY High and after BY High closed in 1968, graduated from Provo High School in 1969. She graduated from Brigham Young University with a bachelor's degree in elementary education and a teaching certificate. She was a BYU folk dancer and toured Europe with them. She taught Kindergarten and First Grade at Maeser Elementary School in Provo, Utah. When her first child was born she retired from school teaching and became a full-time mother and homemaker. She has been engaged in that capacity ever since. She created in her home a place of peace and refuge and all who entered enjoyed the feeling. Her children and husband know they are loved and cared for. She supported her husband in all his endeavors. She was a gracious hostess. She is a member of the Church of Jesus Christ of Latter day Saints and has served in many capacities. She served in the ward as Junior Sunday School Coordinator, Primary teacher and counselor in the presidency, Young Women's President, counselor and advisor, Relief Society President and counselor, and in the stake as a counselor in both the Stake Primary Presidency and Stake Relief Society Presidency. She was a family history consultant. She served on scout committees, as a unit commissioner, and was Woodbadge trained. She attended many recitals, ball games, performances and girls camps. She bottled her own fruit, made excellent blackberry and strawberry jam, sewed, crocheted, quilted, enjoyed being at the temple and working there, organized her family history, located and organized many old family photos, always had a subtle sense of humor about life and her part in it, enjoyed fresh cut flowers in her home, welcomed her children's friends into her home and always kept the refrigerator full to feed them, and was always reading a good book, looked forward to outings with her sisters and friends whom she loved and cherished. Her testimony of the gospel of Jesus Christ is reflected in her family and dedicated life of service. She is survived by her husband, Paul Fenwick Graf of Santa Clara; children: Marianne Graf of Salt Lake City, Utah; Jennie Graf (Cory) Tanner of Lambertville, New Jersey; John F. Graf of Santa Clara, Utah, Brian R. (Ann) Graf of Orem, Utah, Rebecca Graf of Provo, Utah, and grandson, Jacob Tanner; she is also survived by her stepmother, Marjorie Swensen of Provo, Utah, and siblings, Marilyn (Ted) Hess of Nampa, Idaho, Donald (Louise) Swensen, of Sandy, Utah, John Swensen of Lehi, Utah, Philip (Dana) Swensen of Hyde Park, Utah, Margaret Swensen(Dennis) Lifferth of Centerville, Utah. She is preceded in death by her parents, Albert Donald Swensen and Jennie Romney Swensen, and her sister in law, Markay Bruggeman Swensen. Funeral services will be held Wednesday, April 21, 2010 at 11:00 a.m. at the Santa Clara LDS Stake Center, 1706 Desert Dawn Dr., Santa Clara, Utah. Visitations will be held Tuesday, April 20th from 6:00 to 8:00 p.m. at Metcalf Mortuary, 288 W. His parents were Knud (Canute) Svendsen and Anne Maria Hansen Svendsen. He married twice: First, Milo Abercrombie in about 1920 (divorced); and second, Loretta Brunner on April 18, 1929. He died in November 1942.

Pep Club, Hi-Steppers, F.H.A., Ski Club Vice President, Chorus, Wildcat Yearbook Staff, Seminary 4 years, Junior Varsity Cheerleader, Model U.N., Seminary Secretary. BYU-Hawaii 1968. BYU BA English 1969. Married Dennis Lifferth. News: My life has been turned upside-down because of a new calling. I have been assigned to attend the Philmont Scout Meeting in New Mexico. I have six children married and many grandchildren. My husband, Dennis, is still working full time and plans retirement in another five years. He also serves as gardener, main chef on the grill, and Stake Patriarch. This decade of my life (50s) has been my favorite so far -- healthy, happy and enjoying family. All of that has come to a screeching halt since my call as first counselor in the General Primary Presidency in April. I am now on a steep learning curve. It is both a privilege and a sacrifice to serve. If my best is good enough, then I can succeed. My top ten memories of BY High include: 1. The smell of tuna sandwiches in my locker, and warm lunch hours visiting on the lawn. 2. Winning the state championship in basketball when we were in ninth grade. 3. Junior Prom and "Elsha 1776" cologne. 4. Matinee dances in the Arts Building before they built the carrells there. 5. The carrells and passing notes -- and lots of other things -- during Algebra. 6. Football games in the brand new BYU stadium. Our whole school took up a couples of rows in the stands, but we cheered loudly, and once in a while we even won the game. 7. Working on the yearbook with Reed Smoot and Mr. Garside. 8. Making cheerleading posters up on the top floor of the Education Building with Kris, Shirlee, and Colleen. 9. Friday nights at Heaps. 10. Mrs. Julia Caine, Mrs. Anna B. Hart, Mr. Grant Bendixsen, Mr. Louis Chatterley, Coach Courtney Leishman, Mrs. Idell Thurston in the office, and all the other teachers and staff whose hard work and friendly ways continue to influence me even today. ~ ~ ~ ~ Her parents: Albert Donald Swensen [BYH Class of 1933] and Jennie Romney, married June 15, 1937.
